2. Description of Service

Mercy Cards provides electronic invitation card design and distribution services for various events including weddings, sendoffs, kitchen parties, and other celebrations. Our services include card design, distribution via WhatsApp and SMS, QR code integration, location links, card verification, automated reminders, attendance reporting, and thank you messages (features vary by package). We may modify or discontinue any aspect of the service with reasonable notice.

3. User Responsibilities

• You agree to use Mercy Cards services only for lawful purposes and legitimate events.
• You must provide accurate information about your event, including dates, locations, and guest contact details.
• You must not misuse the service to send spam, offensive, fraudulent, or unsolicited messages.
• You are responsible for ensuring you have permission to send invitations to the phone numbers you provide.
• You must not impersonate another person or entity or use the service for deceptive purposes.
• You are responsible for payment according to the selected package and number of invitees.

4. Messaging Services

Our platform integrates with the official WhatsApp Business API and SMS gateway services to deliver your messages. By using these features, you agree to comply with the terms of WhatsApp and the SMS providers.

5. Intellectual Property

All card designs, templates, branding, and proprietary technology associated with Mercy Cards are the intellectual property of Mercy Cards and may not be reused, copied, or distributed without written permission. You retain rights to the specific content you provide (event details, personal information), but the design, layout, and technical implementation remain our property.

6. Termination

We reserve the right to suspend or terminate your access to the service if you violate these Terms or use the platform in a harmful or unlawful manner.

7. Disclaimer of Warranties

We provide the service on an "as is" and "as available" basis without warranties of any kind. We do not guarantee that the platform will be error-free or uninterrupted.

8. Limitation of Liability

In no event shall Mercy Cards be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the service, including but not limited to message delivery delays, technical failures, network issues, or third-party service interruptions. While we strive for reliable service, we cannot guarantee 100% delivery success due to factors beyond our control (network issues, incorrect phone numbers, recipient settings, etc.).

9. Third-Party Links and Services

We may include links to third-party services or APIs (e.g., WhatsApp, SMS gateways). We are not responsible for the content, privacy, or policies of those services.

10. Privacy

Our use of your personal data is governed by our Privacy Policy. Please review it to understand how we collect and handle data.

We may update these Terms at any time. Continued use of the service after changes are posted means you accept the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions.
